Why are we paying again???

I really don't understand the whole 12 month subscription to Xbox Live. Why do we have to folk out money when Microsoft servers aren't up to par with the service?
A very good example is New Year season 2007-2008 during that time frame the servers couldn't support "apparently record number of new Xbox Live accounts being logged in." BUT, this is the same year Halo 3 debute, but there were millions of Xbox Live users logging into the servers, but no crashes were evident. I personally think some thing else was going on during New Year 2007-2008 season, and it didn't involve record numbers...just Mircosoft's crappy servers. Shouldn't are money go toward their servers to be repaired. It'll happen again this season, just watch.
Playstation Network is free, and so should Xbox Live. A multi-billion company should pay us for using their service.
